Liability Waiver | The Surf Society

In consideration of being allowed to participate in any way with SURF SOCIETY LLC RENTAL PROGRAM related events and activities and rental of equipment, I appreciate and agree that:

1. Risk of Injury

The risk of injury from the activities involved in our programs or the rental of equipment is significant, including the potential for permanent paralysis or death, and while particular rules, equipment, and personal discipline may reduce these risks, the risk of serious injury does exist.

2. Assumption of Risk

I KNOWINGLY AND FREELY ASSUME ALL SUCH RISK, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation.

3. Equipment Responsibility

I willingly agree to comply with the stated and customary terms and conditions for the use of the rented equipment while participating and be responsible for any loss or damage to said equipment, and injury to myself or third parties. I have inspected said equipment prior to use and have found it to be in safe and satisfactory condition.

4. Release and Indemnification

I for myself and on behalf of my heirs, assigns, personal representatives and next of kin HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS SURF SOCIETY LLC RENTAL PROGRAM, their officers, officials, agents and/or employees, and if applicable, owners and lessors of premises used for the activity ("Releases"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss of damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASES OR OTHERWISE, to the fullest extent permitted by law.

Acknowledgment

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

I acknowledge and agree that I will be responsible for the repair or replacement, at full retail value, to the equipment listed on my order form for any reason other than reasonable wear and tear. I authorize SURF SOCIETY LLC RENTAL PROGRAM to charge my card for the full retail value of any lost or damaged items. Upon circumstances of unreturned property, we will pursue legal action.

5. Parental/Guardian Consent (For Participants Under 18)

This is to certify that I, as parent/guardian with legal responsibility for this participant under 18 years of age, do consent and agree to his/her release, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releases from any and all liabilities incident to my minor child's involvement or participation in these programs as provided above.
